Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and Mintzer Technologies Private Limited (“Mintzer”, “we”, “us”, or “our”) governing your access to and use of:

  • the Mintzer mobile applications on Google Play (com.mintzer) and the Apple App Store;
  • the website mintzer.in and related pages; and
  • related services, content, and support (together, the “Services”).

By downloading the app, creating an account, accepting a deal, or using the website, you agree to these Terms, our Privacy Policy, and our Refund and Cancellation Policy. If you do not agree, do not use the Services.

2. Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter a binding contract.
  • You must be able to lawfully use a payment card and shop on third-party stores under their terms.
  • You represent that information you provide (including PAN and bank details) is accurate and belongs to you (or that you are authorised to use it).
  • The Services are intended primarily for users in India. We may refuse, restrict, or terminate access where required by law or risk controls.

3. What Mintzer is (and is not)

Mintzer is a deals platform. We list store deals (for example on Flipkart, Amazon, and similar marketplaces). When you accept a deal, you place the order on the store using the card and product details shown, ship to the delivery address listed on that deal, submit proof in the app, and — after successful verification — receive earn paid to your bank.

Mintzer is not:

  • a bank, NBFC, payment wallet, or card issuer;
  • the e-commerce store where you check out (Flipkart, Amazon, etc. are separate);
  • a holder of a spendable in-app cash balance that you can withdraw like a wallet app.

Wallet in the app is an earn history view (for example amounts already paid to your bank and amounts still pending). Payouts are bank transfers after verification — not an in-app cash-out button.

4. Account registration and security

  • Login is by mobile number and OTP (or other methods we may add).
  • You are responsible for activity under your account and for keeping your device secure.
  • Do not share OTPs, passwords, or access to your account with anyone — including people claiming to be Mintzer support.
  • Notify us promptly at Contact@mintzer.in if you suspect unauthorised use.
  • We may suspend or terminate accounts that appear abusive, fraudulent, or in breach of these Terms.

5. KYC and payout details

  • PAN is collected when you accept your first deal — not as a login wall.
  • You must provide accurate bank (and optional UPI) details so we can pay earn.
  • Account holder name should match your verified PAN name where required for payouts.
  • You authorise us and our payout partners to process transfers to the details you provide.
  • Failed payouts caused by incorrect bank details may be delayed until corrected; we are not liable for delays caused by wrong information you supplied or by your bank.

6. Deals and how they work

6.1 Deal listings

Each deal may specify product, store, required card, spend, earn amount, timers, quantity, colour/variant, and the delivery address for checkout. Deal availability, earn, and terms can change. Listing a deal is not a guarantee that you will be able to accept or complete it.

6.2 Accepting a deal

Accepting a deal means you agree to complete it according to the in-app instructions and these Terms, within the time limits shown. We may limit how many deals you can hold at once (including one active placement).

6.3 Ordering

  • Place the order on the specified store using the card and product details on the deal.
  • Enter the delivery address shown in the app for that deal exactly. Do not use your home address unless the deal explicitly lists it.
  • You are responsible for the store checkout, pricing at the moment of purchase, shipping choices, and the store’s own policies.

6.4 Proof and status updates

You must submit Order ID, tracking, invoice, and any other proof requested in the app, within the timers shown. Late, incomplete, or mismatched proof may delay or reduce payout, or cancel earn eligibility.

6.5 Store relationship

Your purchase contract is with the store. Mintzer is not the seller of the product on that store. Cancellations, returns, replacements, and refunds are governed by the store. If the store cancels or the order fails, report it in the app — do not assume Mintzer payout will still apply.

7. Earn and payouts

  • Earn means the amount Mintzer agrees to pay you for a successfully verified completed deal, as shown in the app (subject to these Terms).
  • Earn is not a promise of bank or store cashback. Any card cashback is between you and your card issuer.
  • After successful verification, we aim to pay earn to your bank within 48 working hours. We do not process payouts on bank / RBI holidays. If the window ends on a holiday, payout moves to the next working day.
  • We may delay, withhold, adjust, or refuse payout if proof is missing, details do not match the deal (product, address, quantity, invoice, GST, or other required fields), fraud is suspected, or law requires it.
  • Taxes, if applicable on your income, are your responsibility unless law requires us to deduct or report something specific.

8. Acceptable use

You agree not to:

  • misrepresent orders, upload fake invoices, or manipulate tracking;
  • use stolen cards, mule accounts, or another person’s KYC without authority;
  • create multiple accounts to evade limits or abuse promotions;
  • harass staff or other users, or attempt to social-engineer OTPs or credentials;
  • reverse engineer, scrape, or disrupt the Services except as allowed by law;
  • use the Services for any illegal purpose.

We may investigate and take action including deal cancellation, payout hold, account suspension, and reporting to authorities.

9. Fees

Downloading the app is free. We do not charge a separate “withdraw fee” because payouts are bank transfers of earn. Third parties (stores, banks, networks) may charge their own fees; those are not controlled by Mintzer.

10. Intellectual property

The Services, including branding, logos, UI, text, and software, are owned by Mintzer or its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the apps and website for personal, lawful use in line with these Terms. You may not copy, modify, or redistribute our materials except with written permission or as required by law.

Store names and trademarks (Flipkart, Amazon, card networks, etc.) belong to their owners and are used only for identification.

11. Third-party services

The Services depend on third parties (app stores, SMS/OTP, verification, payout rails, cloud hosting, e-commerce sites). We are not responsible for outages, policy changes, or acts of those third parties beyond our reasonable control.

12. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEAL LISTINGS WILL ALWAYS BE AVAILABLE OR ACCURATE IN REAL TIME. YOU USE THIRD-PARTY STORES AND CARDS AT YOUR OWN RISK SUBJECT TO THEIR TERMS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINTZER AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE TOTAL EARN ACTUALLY PAID TO YOU BY MINTZER IN THAT PERIOD FOR THE DEAL(S) GIVING RISE TO THE CLAIM (OR INR 5,000 IF GREATER LIABILITY LIMITATION IS NOT PERMITTED TO REFERENCE EARN). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM PERMITTED BY LAW.

Nothing in these Terms excludes liability that cannot be excluded under Indian law (including for fraud or wilful misconduct where such exclusion is prohibited).

14. Indemnity

You agree to indemnify and hold harmless Mintzer and its officers, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, your store orders, or your violation of law or third-party rights.

15. Suspension and termination

  • You may stop using the Services at any time and may request account deletion from Profile, except while an order is in progress (including payout wait).
  • We may suspend or terminate access immediately for breach, fraud risk, legal requirement, or prolonged inactivity.
  • Provisions that by nature should survive (including payouts already due subject to verification, IP, disclaimers, liability limits, indemnity, and governing law) will survive termination.

16. Changes to the Services or Terms

We may update the Services and these Terms. The “last updated” date will change when Terms are revised. Material changes may be notified in-app or on the website. Continued use after changes take effect constitutes acceptance, to the extent permitted by law. If you do not agree, stop using the Services.

17. Electronic communications

You consent to receive agreements, notices, and disclosures electronically (in-app, SMS, email, or WhatsApp). Such communications satisfy any legal requirement that they be in writing.

18. Governing law and disputes

These Terms are governed by the laws of India. Courts in Kumbakonam, Tamil Nadu shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you. Before filing a claim, please contact us so we can try to resolve the issue informally.

19. General

  • Entire agreement. These Terms, the Privacy Policy, and the Refund and Cancellation Policy are the entire agreement between you and Mintzer regarding the Services.
  • Severability. If a provision is unenforceable, the rest remains in effect.
  • No waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or corporate reorganisation.
  • Force majeure. We are not liable for delays caused by events beyond reasonable control (including outages at stores, banks, networks, or natural disasters).
  • Language. If we provide translations, the English version controls unless law requires otherwise.
